Participation Agreement, Waiver, and Release of Liability

Welcome! Before we get moving together, please take a few minutes to read this agreement carefully. It explains the risks of participating in online Pilates and movement classes, your responsibilities as a participant, and the legal terms that apply to your membership.

1. About This Agreement

This Participation Agreement, Waiver, and Release of Liability (the “Agreement”) is a legally binding contract between you, the undersigned participant (“you,” “your,” or “Participant”), and Beth Hawkins, operating as Beth Hawkins Movement Studio (the “Instructor,” “we,” “us,” or “our”). It applies to your participation in any classes, workshops, on-demand content, live Zoom sessions, coaching, coffee chats, or related programming offered through the Beth Hawkins Movement Studio online membership (collectively, the “Program”).

2. Nature of the Program

The Program includes Pilates-based exercise, mat and movement classes, mobility work, breathwork, meditation, and related fitness instruction delivered virtually through live Zoom classes and an on-demand video library. The Program is general fitness instruction. It is not personalized medical treatment, physiotherapy, or rehabilitation, and it is not a substitute for advice, diagnosis, or treatment from a qualified healthcare provider.

3. Acknowledgment and Assumption of Risk

You understand and acknowledge that physical exercise, including Pilates and movement classes, carries inherent risks. These risks include, but are not limited to:

  1. muscle strains, sprains, tears, joint injuries, fractures, and other musculoskeletal injuries;
  2. cardiovascular events, including elevated heart rate, dizziness, fainting, heart attack, or stroke;
  3. injuries from equipment, props, mats, flooring, household objects, pets, or other hazards in your home or chosen practice environment;
  4. injuries caused by performing exercises with improper form, especially given the limitations of online instruction where the Instructor cannot physically observe or correct you in real time;
  5. aggravation of pre-existing conditions, including but not limited to back, neck, shoulder, hip, knee, or pelvic floor issues, hernias, osteoporosis, joint replacements, or post-surgical limitations;
  6. the risk of injury from following instructions remotely without hands-on supervision.

You voluntarily and knowingly assume all of these risks, both known and unknown, and accept full responsibility for any injury, illness, loss, or damage that may result from your participation in the Program.

4. Health Representation and Medical Clearance

You represent and confirm that:

  1. you are in good general health and physically able to participate in moderate physical activity;
  2. you have consulted, or had the opportunity to consult, with a qualified healthcare professional before beginning the Program, particularly if you have any medical condition, are pregnant or postpartum, are recovering from surgery or injury, or have been advised by a healthcare provider to limit physical activity;
  3. you will inform the Instructor in advance of any medical conditions, injuries, limitations, or concerns that may affect your participation, although you understand the Instructor is not obligated to modify the Program based on this information;
  4. you will stop participating immediately and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, or any other warning sign during a class.

The Instructor is not a doctor, physiotherapist, dietitian, chiropractor, or licensed mental health professional. Nothing in the Program constitutes medical advice, diagnosis, or treatment.

5. Your Responsibilities as a Participant

You agree that:

  1. you will participate at your own pace and within your own physical abilities;
  2. you will modify, pause, or skip any exercise that does not feel right for your body;
  3. you are solely responsible for ensuring your home or other practice space is safe, clear of hazards, and suitable for the activity, with adequate room to move freely;
  4. you will use appropriate equipment in good working condition (mat, props, supportive surface, etc.);
  5. you will not participate while under the influence of alcohol, recreational drugs, or any substance that impairs judgment or coordination;
  6. you understand that the Instructor cannot fully see you, cannot guarantee that your form is correct, and cannot intervene physically — your safety is ultimately your responsibility.

6. Release and Waiver of Liability

To the fullest extent permitted by law, you hereby release, waive, and discharge Beth Hawkins, Beth Hawkins Movement Studio, and any of her contractors, employees, agents, partners, successors, or representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, lawsuits, damages, costs, expenses (including legal fees), and liabilities of any kind — whether known or unknown, foreseen or unforeseen — arising out of or related to your participation in the Program, including any injury, illness, loss, or damage you may suffer.

This release applies whether the claim arises from the negligence of the Released Parties or from any other cause, except for liability that cannot be waived or excluded under applicable law (including, where applicable, gross negligence or wilful misconduct).

7. Indemnification

You agree to indemnify and hold harmless the Released Parties from any claim, loss, damage, liability, or expense (including reasonable legal fees) brought by you, your family, your estate, your heirs, or any third party that arises out of or relates to your participation in the Program, your use of any Program materials, or your breach of this Agreement.

8. Photo, Video, and Recording

Live Zoom classes may be recorded for replay, training, or marketing purposes. You may keep your camera off during class if you wish. By keeping your camera on during a class, you consent to being included in the recording and to its use as described in this section. You also consent to the Instructor using anonymized testimonials or feedback that you voluntarily provide. The Instructor will not publicly identify you by full name or share identifiable images of you for marketing without your separate written permission.

You agree that you will not record, screenshot, share, redistribute, or publicly post any class recordings or Program materials without the Instructor’s prior written permission.

9. Membership Terms

Membership is billed monthly at the rate disclosed at sign-up. Founding member rates, when offered, apply only to qualifying members and remain in place for as long as the membership is active and uninterrupted; if membership lapses or is cancelled, the founding rate is forfeited and standard pricing applies on rejoining.

You may cancel your membership at any time. Cancellations take effect at the end of the current billing period, and fees already paid are non-refundable except as required by law. The Instructor reserves the right to update class schedules, content, pricing (with reasonable notice for existing members), and Program features from time to time.

10. Intellectual Property

All Program content — including videos, written materials, class structures, sequences, branding, and recordings — is the intellectual property of Beth Hawkins. Your membership grants you a personal, non-transferable, non-exclusive licence to access and use this content for your own personal use only. You may not reproduce, redistribute, sell, teach from, or commercially exploit any Program content.

11. Privacy

Personal information you provide will be handled in accordance with Beth Hawkins Movement Studio’s privacy practices and applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA). Your information is used to deliver the Program and communicate with you, and is not sold to third parties.

12. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute arising out of or related to this Agreement or your participation in the Program will be subject to the exclusive jurisdiction of the courts of the Province of Ontario.

13. Severability

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

This Agreement represents the entire agreement between you and Beth Hawkins Movement Studio regarding your participation in the Program and supersedes any prior understandings, communications, or agreements, whether oral or written.

Acknowledgment and Acceptance

I have read this Participation Agreement, Waiver, and Release of Liability carefully. I understand its terms and the legal rights I am giving up. I am at least 18 years of age and I am signing freely and voluntarily on my own behalf. I accept the risks of participation and I agree to all of the terms above.
